Rankwell AI — Terms of Service

These Terms of Service ("Terms") govern your use of the Rankwell AI website and services (the "Service"), operated by Altisima Inc., a Florida corporation ("Altisima," "we," "us"). By using the Service, you agree to these Terms.

1. The Service

Rankwell AI provides an AI-assisted platform for managing Google Business Profiles and related online presence. Features may include managing business information, posts, reviews, and performance insights, with AI-generated drafts presented for your review and approval before publishing.

2. Eligibility and accounts

You must be at least 18 and able to form a binding contract. You are responsible for your account credentials and all activity under your account, and for providing accurate information.

3. Authorization and your responsibilities

You represent that you are authorized to manage any Google Business Profile you connect to the Service, and that your use complies with all applicable Google terms and policies, including the Google Business Profile and Google API policies. You are responsible for the accuracy and lawfulness of content you publish through the Service.

4. Acceptable use

You agree not to misuse the Service, including by violating laws, infringing rights, attempting unauthorized access, posting deceptive or prohibited content, or interfering with the Service's operation.

5. Third-party services

The Service integrates with third-party platforms (including Google). Your use of those platforms is governed by their terms. We are not responsible for third-party services.

6. Fees

Fees, if any, will be disclosed to you before you incur them. (Pricing terms to be added.)

7. Intellectual property

We retain all rights in the Service. You retain rights in your content and grant us a limited license to process it solely to provide the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee specific results such as rankings, traffic, or visibility.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTISIMA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Indemnification

You agree to indemnify Altisima against claims arising from your use of the Service or your violation of these Terms.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida. Any dispute will be resolved by binding arbitration administered by JAMS in Miami-Dade County, Florida, on an individual basis. You waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@rank-well.com.

12. Changes

We may update these Terms; material changes will be posted with a revised date.
